Terms of Service

These Terms of Service govern your access to and use of the Tunnee website, APIs, software, tunneling services, and related services.

These Terms of Service (“Terms”) govern your access to and use of the Tunnee website, APIs, software, tunneling services, and related services (collectively, the “Service”) provided by Tunnee (“Tunnee”, “we”, “our”, or “us”).

By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not use the Service.


1. Eligibility

You must be at least 18 years old to use the Service.

By using Tunnee, you represent and warrant that:

  • You are legally capable of entering into binding agreements
  • You will comply with these Terms and all applicable laws
  • You are authorized to use the Service on behalf of any organization you represent

2. Description of Service

Tunnee provides secure tunneling, networking, and developer infrastructure services that allow users to expose local or private services to external networks.

Tunnee may modify, suspend, or discontinue any part of the Service at any time.


3. Accounts

To access certain features, you may be required to create an account.

You are responsible for:

  • Maintaining the security of your account credentials
  • All activity occurring under your account
  • Promptly notifying us of unauthorized access or security incidents

You must provide accurate and current information when registering for the Service.


4. Free Tier and Usage Limits

Tunnee may offer a free tier of the Service subject to usage limits and restrictions, including but not limited to:

  • Bandwidth caps
  • Connection limits
  • Rate limiting
  • Tunnel count restrictions
  • Reduced availability guarantees

Free tier accounts may be throttled, rate-limited, or temporarily restricted during periods of high demand or when usage exceeds fair use thresholds. Tunnee reserves the right to adjust free tier limits at any time with reasonable notice.

Free tier accounts are not eligible for Service Level Agreement (SLA) commitments.


5. Acceptable Use

You may not use the Service to:

  • Violate any law or regulation
  • Host or distribute malware
  • Conduct phishing or fraud
  • Distribute spam or abusive content
  • Access systems without authorization
  • Interfere with or disrupt networks or services
  • Circumvent security measures
  • Distribute illegal or infringing material
  • Operate botnets or malicious infrastructure
  • Abuse shared infrastructure or resources

Your use of the Service is also governed by our Acceptable Use Policy, which is incorporated into these Terms by reference.

Tunnee reserves the right to suspend or terminate accounts involved in abusive, harmful, or unlawful activity.


6. User Content and Traffic

You retain ownership of your applications, services, and content transmitted through the Service.

Tunnee does not claim ownership of tunnel traffic or hosted content.

You are solely responsible for:

  • Content transmitted through tunnels
  • Security of exposed services
  • Compliance with applicable laws
  • Proper authentication and access controls

Tunnee is not responsible for publicly exposed endpoints or user misconfiguration.


7. Feedback

If you submit feedback, ideas, or suggestions regarding the Service, you grant Tunnee a non-exclusive, royalty-free, perpetual license to use and act on that feedback without restriction or obligation to you.


8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the Service, you acknowledge that Tunnee may process account information, tunnel metadata, and technical operational data as described in the Privacy Policy.


9. Payments and Billing

Certain features of the Service may require payment.

Payments are processed by Stripe.

By purchasing a paid plan, you agree:

  • To pay all applicable fees
  • That subscriptions may renew automatically unless canceled before the renewal date
  • That failure to pay may result in suspension or termination of access
  • That taxes are your responsibility unless Tunnee is required to collect them

Pricing may change with reasonable advance notice.


10. Refunds

Tunnee offers a 14-day refund period from the date of initial purchase or subscription renewal, in accordance with applicable EU consumer protection law.

To request a refund, contact support@tunnee.com within 14 days of the charge.

The following are not eligible for refunds:

  • Accounts suspended or terminated for violations of these Terms or the Acceptable Use Policy
  • Charges older than 14 days
  • Usage-based fees already consumed

Nothing in this section limits any statutory rights you may have under applicable law.


11. Availability and Service Reliability

Tunnee strives to provide reliable service but does not guarantee uninterrupted availability.

The Service may experience:

  • Downtime
  • Maintenance interruptions
  • Network failures
  • Security incidents
  • Third-party infrastructure outages

The Service is provided on an “as is” and “as available” basis.


12. Third-Party Providers

Tunnee relies on third-party providers, including:

  • Cloudflare
  • Hetzner
  • Sentry
  • Stripe

Tunnee is not responsible for outages, failures, or actions caused by third-party services.


13. Suspension and Termination

Tunnee may suspend or terminate your access immediately if:

  • You violate these Terms or the Acceptable Use Policy
  • Your use creates security or operational risks
  • Required by law
  • Necessary to prevent abuse or harm

You may stop using the Service and delete your account at any time.

Upon termination, your right to use the Service ceases immediately. Tunnee will handle your data following termination as described in the Privacy Policy. Termination does not relieve you of obligations incurred before termination.


14. Force Majeure

Tunnee shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to:

  • Natural disasters or extreme weather events
  • Acts of government or regulatory actions
  • Internet or telecommunications infrastructure failures
  • Third-party infrastructure outages (including hosting or DNS providers)
  • Cyberattacks or large-scale security incidents
  • Pandemic or public health emergencies

In such events, Tunnee will make reasonable efforts to restore the Service as soon as practicable.


15. Intellectual Property

The Service, including software, branding, design, and documentation, is owned by Tunnee and protected by intellectual property laws.

You may not:

  • Copy or redistribute the Service
  • Reverse engineer the platform except where permitted by law
  • Use Tunnee branding without permission

16. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided:

  • “As is”
  • “As available”
  • Without warranties of any kind

Tunnee disclaims all warranties, including:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Reliability or uninterrupted availability

17. Limitation of Liability

To the maximum extent permitted by law, Tunnee shall not be liable for:

  • Indirect or consequential damages
  • Data loss
  • Business interruption
  • Security incidents
  • Lost profits or revenue

Tunnee’s total liability arising from the Service shall not exceed the amount paid by you to Tunnee during the 12 months preceding the claim.


18. Indemnification

You agree to indemnify and hold harmless Tunnee from claims, damages, liabilities, and expenses arising from:

  • Your use of the Service
  • Your violation of these Terms or the Acceptable Use Policy
  • Content or services exposed through your tunnels
  • Violations of law or third-party rights

19. Consumer Rights

Nothing in these Terms is intended to limit or exclude any rights you may have under applicable consumer protection law, including EU Directive 2011/83/EU on consumer rights and applicable Portuguese law. Where any provision of these Terms conflicts with mandatory consumer protection rights, those rights shall prevail.


20. Governing Law

These Terms shall be governed by and interpreted under the laws of Portugal, without regard to conflict of law principles.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Portugal.


21. Notices

Tunnee may send notices to you at the email address associated with your account. Notices are effective upon sending.

You may send notices to Tunnee at support@tunnee.com.

It is your responsibility to keep your registered email address current and accurate.


22. Entire Agreement and Severability

These Terms, together with the Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and Tunnee regarding the Service and supersede any prior agreements.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.


23. Changes to These Terms

Tunnee may update these Terms from time to time.

Material changes will be communicated via email to your registered address or through a prominent notice within the Service, with at least 14 days’ notice where reasonably practicable.

Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
